A botnet doesn't neccessairly have to be used for anything illegal or malicious.

I have all the proof of what you hosted on that dedicated server.
You can send a lawyer letter at any of our address on our company website : www.acuata.com
We are not hidding and im 100% transparent with my users.
I will be happy to provide all the proof to your lawyer.
That will be my only message about that case.

Even if he was to host a botnet on that server, it could've been to maintain multiple systems on one large network (which is usually what botnets are used for). Unless you have proof he held systems without their knowledge, he'll win the case.
